Principle Publication of contributions and content in the LastDraw community

(English translation*)

LastDraw enables its users to publish contributions and other content (e.g. photos, videos) within the framework of the LastDraw community, to exchange opinions and information, to ask questions and to make contact with others LastDraw users. When posting contributions and other content, especially personal comments or views, members should always ensure that they respect each other and adhere to generally accepted behavior. Posts that promote, promote, or glorify hatred, crime, violence, or racism are not welcome in the LastDraw community and are prohibited.

Who is responsible for community publications?

Contributions that a LastDraw member publishes in the community only represent the opinion of the respective member. LastDraw is not responsible for contributions and content posted by members. Members are generally responsible for all activities carried out through their member account. If the member is not responsible for the misuse of his member account because there is no breach of the existing duty of care, the member is not liable.

The contributions and content published by members are generally not checked by LastDraw for legality, correctness and completeness.

LastDraw reserves the right to delay and reject the publication of articles or other content and to deny or restrict members' use of the community. Members are responsible for archiving the articles and content they have published on a storage medium independent of LastDraw.

What posts and content are not allowed in the LastDraw Community?

Forbidden:

The publication of the following contributions and other content in particular (list not complete) is prohibited:

• Personal data of a person such as publishing the name, address, occupation, telephone number or email address. Exceptions are personal data of business or tradespeople or companies who have published this data as part of their work on the LastDraw website itself or on their own website (e.g. in the imprint). LastDraw reserves the right to delete abusive posts or content.
• Publication of email correspondence, correspondence and trade secrets or other confidential data or data not intended for the public.
• To publish immoral, pornographic, youth-endangering or violence-glorifying contributions or other content that spreads, promotes or glorifies hatred, violence or racial discrimination, or links to corresponding content on other websites.
• To violate the LastDraw Terms and Conditions or the LastDraw Principles, to request this or to point out methods by which the LastDraw Terms and Conditions or the LastDraw Principles can be circumvented or to link to articles or other content of this type.
• To violate applicable law or to demand violations of the law or to link to corresponding contributions or other content
• Publishing false statements of facts, insults or defamatory criticism or to use generally vulgar or obscene language and disrespectful, provocative and aggressive treatment of other members.
• Posts and other content with misleading content. Specifically, this includes articles that are likely to mislead the author or that purport to be from a LastDraw contributor.
• Infringement or request to infringe the intellectual property rights of third parties, in particular copyright and trademark law, when publishing articles and other content. In particular, the LastDraw member assures that he has created the contributions and content that he publishes himself or that he is authorized to publish them. When publishing photos and videos, the LastDraw member assures that they have received the consent of all persons who are depicted to be published in the LastDraw community.
• Any kind of commercial use of the LastDraw community, including but not limited to promoting the purchase or sale of products or services outside the LastDraw Marketplace and linking to websites that offer products or services.
• Publication of search orders or other posts that express interest in a trade or service outside of the LastDraw marketplace.
• Use of HTML and JavaScript functions that are not allowed with LastDraw.

Journalists need authorization before posting articles or other content as part of their professional activities.

Publication outside of the LastDraw Community

LastDraw offers the LastDraw member the technical possibility to link and publish the content published in the LastDraw Community using appropriate buttons on Twitter, Facebook or other social media services.

LastDraw reserves the right to use the content published by the members of the LastDraw community on other websites, in particular on the LastDraw social media websites or in other media, or to have third parties use it. For this purpose, the LastDraw member of Last Media GmbH, Reuthbergstr. 16, 95488 Eckersdorf, Germany, free of charge the non-exclusive, temporally, geographically and content-wise unlimited, transferable and sublicensable right to make the content publicly available, reproduce, edit and combine and distribute it with other content.

Violation of this principle

Note: The decision as to whether there is a violation of our principles rests solely with LastDraw. You can be assured that we will carefully examine any report of a breach of our policy.

Failure to comply with this policy can have one or more of the following consequences:

• restriction of use of the LastDraw marketplace (i.e. you can no longer buy, bid or sell)
• temporary or permanent exclusion from the LastDraw marketplace
• deletion of active (and already terminated )offers from
